CONTENT OF THIS PAGE

TERMS AND CONDITIONS OF THE LEASE AGREEMENT

The lessor company CAYO CRETA S.A. hereby leases vehicles to customers-renters, under the condition that the latter acknowledge and agree with the following:

  1. The leased vehicles are part of the lessor company’s property. This is solely a rental contract, and the customer-renter acknowledges that they have no other rights or claims beyond those stated in this rental agreement.
  2. If the lessee violates the lease agreement terms regarding the rented vehicle, the lessor company has the right to take legal action against the lessee.
  3. The lessor company has the right to repossess the rented vehicle from the lessee in case the terms of the lease agreement are not adhered to.

Driver

  1. The driver must be at least 21 years old for any vehicle rental.
  2. The driver is required to hold a valid driver’s license for at least one year already. The driver’s license can be issued in Greece or anywhere else in the European Union, or the driver can hold a valid International Driving Permit (IDP).
  3. The driver must have a valid credit or debit card, acceptable by the company, for all necessary pre-approval amounts and rental costs. For the validity of charges on the card, the cardholder is the one who will be listed as the driver on the rental agreement.
  4. The rented vehicle should not be driven by anyone other than the lessee-driver unless with the lessor company’s consent to approve another person as a second, third, etc. driver.

Booking / Rental / Returns / Changes / Availability

  1. The lessee-customer must return the rented vehicle to the pre-agreed location and on the pre-agreed day and time, according to the terms set in the lease agreement.
  2. If the lessee-customer does not return the rented vehicle to the agreed location and on the agreed day and time, the lessee is obliged to compensate the lessor company.
  3. Returning the vehicle to a location other than the agreed one will incur an additional cost for the lessee, according to the company’s pricing policy.
  4. Communication with the company is mandatory in case of any modifications to the existing rental.
  5. For any changes in the rental, the cost will be re-calculated based on availability and prices on the day of the modification.
  6. In case of early return of the vehicle before the agreed return date and time, no refund will be provided to the lessee.
  7. All reservations are subject to availability. The company reserves the right to provide a different car model from the one initially reserved, with an equivalent or superior model.
  8. At the end of the agreed lease period, the company allows a grace period of 29 minutes without charge. After that, the lessee will be charged for at least one full day of rental.
  9. If lessee-customer wants to extend the rental period, he shall inform the office at least 48 hours before the agreement expires and only if the vehicle is available.

Vehicle

  1. During the rental period, the lessee-customer is responsible for taking care of the vehicle and its condition, such as oil, water, tire pressure, etc. Any repairs by the lessee without the lessor company’s consent will not be accepted.
  2. The lessee-customer must always lock and secure the rented vehicle to protect it.
  3. The lessee-customer is responsible for the vehicle’s condition and must return it in the same condition as received, including any related items provided (keys, cables, child seat, etc.). If the vehicle is deemed excessively dirty upon return, the lessee-customer will be charged for cleaning expenses to the lessor company.
  4. The lessee-customers should not use the vehicles of the lessor company for:
  5. A) Violating the terms of the lease agreement.
  6. B) Transporting third parties or subleasing to others.
  7. C) Towing other vehicles or objects.
  8. D) Carrying heavy objects, flammable materials, dirty and foul-smelling materials, as well as narcotics, explosives, and weapons.
  9. E) Carrying more people than allowed by the law, the registration, and the lease agreement terms.
  10. F) Participating in races and competitions.
  11. G) Being under the influence of alcohol or drugs.
  12. Fuel Payment: The return of the vehicle with insufficient fuel quantity will incur a cost to the lessee for the fuel and an additional 10€ service fee.
  13. Roadside assistance services are provided for all vehicle groups, provided that the approach to the vehicle is possible. In case of vehicle immobilization due to low battery or low fuel level, the renter will be charged 30€ for the vehicle’s transportation to the nearest charging point or gas station.

Insurance

  1. The lessee-customer is responsible for any expenses arising from damage to the rented vehicle. The Collision Damage Waiver with Excess (C.D.W.I.) is valid only if the lessee-driver does not drive on unpaved roads, is not under the influence of alcohol and narcotics, and does not violate the terms of the Greek Traffic Code.
  2. The Collision Damage Waiver (C.D.W.I.) does not cover any lessee-customer in the case of damage or destruction to tires, crystals, mirrors, interior, underside of the vehicle, or in the event of key loss.
  3. All authorized drivers of our vehicles are covered by liability insurance for death, injury, and property damage to third parties. Both coverages are subject to the general terms of the insurance policy that the company has with the cooperating insurance company. No type of insurance coverage is provided to unauthorized drivers of the company’s vehicles.
  4. Collision Damage Waiver with Excess (CDW): The renter’s liability for damage to the rented vehicle, provided that the Greek Traffic Code (K.O.K.) is not violated, is limited to a maximum charge of 1000€ for all vehicle groups. Damages to the underside, wheels, tires, and windows of the vehicle are not covered.

Damage / Accident / Loss / GDPR

  1. In the event of an accident, the lessee-customer must:
  2. A) Stay at the scene where the accident occurred,
  3. B) Immediately inform the police,
  4. C) Not admit any responsibility or fault without the consent of the lessor company,
  5. D) Notify the lessor company immediately,
  6. E) Obtain the necessary information.
  7. The lessee-customer exempts the lessor company and its employees from any liability in case of loss of personal belongings that the lessee has forgotten or left in the vehicles of the lessor company.
  8. In case of theft or loss of the rented vehicle, the lessee must pay all expenses incurred by the company due to such an event. Under specific conditions (provided there is written theft insurance coverage and with the company’s agreement), the lessee-customer can be exempted from liability for such an event.
  9. The personal data of the driver and any other occupants will be disclosed to the Police and other competent Authorities when they operate within their duties in case of accidents or other incidents.

Compliance

  1. The lessee-customer is responsible for any violation of the Greek Traffic Code (K.O.K.) committed by them.
  2. All fines imposed due to drivers’ behavior are the lessee’s sole responsibility.
  3. The lessee-customer is explicitly and categorically prohibited from driving the vehicle outside of Crete or transporting the vehicle on a ship for transport outside of Crete.
  4. Maritime Transport: Transport by ship is prohibited for any of the company’s vehicles.
  5. The lessee-customer must pay the lessor company:
  6. A) The basic cost for the provided service (rental) according to the lease agreement,
  7. B) Taxes calculated according to the laws of the state,
  8. C) The expenses of the company as well as all legal expenses,
  9. D) Fines, penalties, court expenses, etc.
  10. Any disputes that may arise between the lessee-customer and the lessor company shall be governed by Greek law, and the Greek courts shall have jurisdiction.

ONLINE BOOKING TERMS & CONDITIONS

1.1 This Rental Services Agreement does not constitute a contract for the supply of vehicle rental services. The Lease agreement will be supplied under a separate agreement before the vehicle pickup. You will also be subject to our standard conditions as to capacity to drive.

1.2 For Online Bookings, you are entering into this Agreement with Cayo Creta S.A. (CCSA).

2. Terms and Conditions for Online Booking

2.1 By ticking the accept button within the booking process, you are entering into, and are bound by the terms and conditions of, only this Agreement with CCSA. By entering this Agreement, you are agreeing to pay a proportion, or the total amount of the rate quoted by CCSA. CCSA will issue the payment, send it to you by email, and proceed with the Booking.

2.2 You must pay the quoted charges relating to the booking. The rental will not be issued until payment has been made in full. The charges will be deducted from your credit, charge, or debit card at the time of the booking. By entering into this Agreement, you expressly authorize CCSA to debit your credit, charge, or debit card the amount as shown on your booking and the additional charges (if any) referred to in this Agreement.

2.3 All other optional equipment and services (e.g., special equipment, additional drivers, optional insurances, additional days, etc.) will incur additional charges, which you must pay directly to the Hotel Front Office either when you pick up or return your vehicle.

Please notice:
The Cayo Exclusive Resort & Spa website’s booking engine offers the option of online card payment. This card should be under the name of the main driver, who must present it while picking up the car. The booking engine accepts credit/debit/prepaid cards by Eurocard / MasterCard and Visa.
The card will be approved at the rental counter and will be used as a guarantee.
If the payment card is not authorized during the pick-up procedure, the rental will be automatically canceled, and the relevant cancellation fee will apply.

3. Changing Bookings

3.1 Subject to availability and the restrictions in clause 3.2 below, you can change your booking up to 14 days before the picking up of your vehicle by sending an email to reservations@cayoresort.com.

3.2 Changes to your booking are subject to the following restrictions:

a. If you change a booking and the charges for the new booking are greater than the initial amount of payment, you will be charged the difference based on the rates on the date when the modification is applied, and the additional amount will be payable.

b. If the cost of the changed booking is less than the cost of the initial booking, no refund will be made.

No refund is due if the rental costs less than the prepayment.

CANCELLATION POLICY

  1. If you cancel your booking up to 14 days before the day your rental was due to begin, no cancellation fee will be applied, and you will get a full refund.
  2. If you cancel your booking less than 14 days before the day of your rental, there is no refund.
  3. If you don’t collect your vehicle and do not cancel your booking, there is no refund, and the paid amount of your booking will be kept as compensation.
  4. In order to obtain a refund of the amount you have paid for your voucher (where applicable) you must write to reservations@cayoresort.com requesting the money to be refunded.
